1. Executive Summary

These Terms of Service ("Terms", "ToS") constitute a legally binding agreement between you ("User", "you", "your") and Vlogerly ("Vlogerly", "we", "our", "the platform"), which governs your access to and use of the content management and blog publishing platform.

By creating an account, accessing, or using any part of Vlogerly, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the service.

Key information:

  • Vlogerly is a professional blog creation and management platform

  • Account registration is required to access the administrative workspace

  • The content you publish belongs to you; Vlogerly does not claim ownership rights

  • You can cancel your account at any time

  • We reserve the right to suspend accounts that violate these Terms

  • These Terms may be updated; we will notify you of substantial changes

Legal capacity: You must be at least 18 years old or the legal age in your jurisdiction to use Vlogerly. If you are a minor, you need the consent of a parent or legal guardian.


2. Definitions

Vlogerly / We / Platform: Refers to the content management and blog platform operated by Vlogerly, including the administrative workspace (apps/app) and the public blog center (apps/blog-center).

User / You: Any person or entity that creates an account, accesses, or uses Vlogerly's services.

Account: Personal registration created by the User to access the administrative workspace functionalities.

Project: Organizational space within Vlogerly where users manage blog articles for a specific website or brand. Each User can create multiple projects.

Article: Blog content created, edited, and published by the User within a Project using the Tiptap editor.

Blog Center: Public area of Vlogerly where published articles from each Project are accessible to visitors without authentication.

Administrative Workspace: Private control panel where Users manage their Projects, Articles, categories, tags, metadata, and account settings.

User Content: Any text, image, video, metadata, configuration, or information uploaded, created, or published by the User on Vlogerly.

Services: All functionalities, tools, integrations, and features provided by Vlogerly, including but not limited to: project creation, article editor, metadata management, image storage, Open Graph generation, user authentication, and APIs.

Third Parties: External services integrated into Vlogerly, including Firebase (Google), Hotjar, Sentry, Cloudinary, Resend, and any other service provider mentioned in our Privacy Policy.


3. Acceptance of Terms

3.1. Binding Agreement

When creating an account on Vlogerly, the registration form clearly states: "By continuing, you agree to Vlogerly's Terms of Service and Privacy Policy, and to receive periodic emails with updates."

By clicking "Create Account", "Continue with Google", or using any Vlogerly functionality, you confirm that:

  • You have read, understood, and accepted these Terms in their entirety

  • You agree to comply with all applicable laws and regulations

  • You have the legal capacity to enter into this agreement

  • You will provide truthful, accurate, and up-to-date information during registration

3.2. Minimum Age

You must be at least 18 years old to use Vlogerly without restrictions. If you are between 13 and 17 years old, you may only use the platform with the express consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your activity on the platform.

We reserve the right to request age verification at any time. Accounts that do not meet this requirement will be suspended or deleted.

3.3. Changes to Terms

Vlogerly reserves the right to modify these Terms at any time. When we make substantial changes:

  • We will update the "Last updated" date at the beginning of this document

  • We will notify you via prominent notice on the platform and/or email

  • You will have 30 days from notification to review and accept the new Terms

Continued use = Acceptance: If you continue using Vlogerly after the notification period, it will be considered that you have accepted the modified Terms. If you do not agree with the changes, you must stop using the platform and cancel your account before the new Terms take effect.


4. Account Registration and Security

4.1. Account Creation

To access the administrative workspace and create projects, you must register an account by providing:

Required information:

  • Full name

  • Valid email address

  • Secure password (minimum 8 characters, at least 1 uppercase, 1 lowercase, 1 number, 1 special character)

  • Unique username (3-20 characters, only letters, numbers, underscores and dots)

Registration methods:

  • Email and password

  • Google Sign-In (OAuth)

By registering via Google Sign-In, you authorize Vlogerly to access your basic profile information (name, email, photo) according to Google's Privacy Policy.

4.2. Information Accuracy

You commit to providing truthful, accurate, complete, and up-to-date information during registration and to keep it updated at all times. False, misleading, or fraudulent information may result in immediate suspension or deletion of your account.

Vlogerly is not responsible for problems arising from incorrect or outdated information, including the inability to recover your account or receive important notifications.

4.3. Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your password

  • All activities that occur under your account

  • Immediately notifying Vlogerly of any unauthorized use or security breach

Recommended security measures:

  • Use a unique and complex password

  • Do not share your password with third parties

  • Enable two-factor authentication (if available)

  • Log out after using shared or public devices

  • Update your password periodically

Breach notification: If you suspect your account has been compromised, you must change your password immediately and contact our support team at the contact address available in the Privacy Policy.

4.4. One Account Per Person

Each person or entity may only maintain one active account on Vlogerly. Creating multiple accounts for the same user is prohibited, except in cases expressly authorized by Vlogerly (for example, separate accounts for personal and business use with valid justification).

Violation of this rule may result in suspension of all associated accounts.

4.5. Inactive Accounts

Accounts that remain inactive for more than 12 consecutive months (without login or activity) may be marked for review and potential deletion. We will notify you by email 60 days in advance before deleting an inactive account, giving you the opportunity to reactivate it.


5. Permitted Use of the Service

5.1. Use License

Subject to compliance with these Terms, Vlogerly grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the administrative workspace to create and manage Projects and Articles

  • Publish User Content in the Blog Center

  • Use editing tools, metadata, and content management

  • Access the APIs and technical functionalities provided

This license does not include:

  • Reselling, sublicensing, or commercially distributing Vlogerly

  • Modifying, decompiling, or reverse engineering the source code

  • Copying, reproducing, or duplicating the platform for commercial use

  • Creating competitive services based on Vlogerly

5.2. Permitted Uses

You may use Vlogerly to:

  • Create and manage personal or professional blogs

  • Publish blog articles on any lawful topic

  • Organize content through categories, tags, and projects

  • Share knowledge, experiences, tutorials, opinions, and creative content

  • Promote your brand, business, or services legitimately

  • Collaborate on content projects for legal purposes

5.3. Prohibited Uses

It is strictly prohibited to use Vlogerly to:

Illegal or harmful content:

  • Publish content that violates local, national, or international laws

  • Share material that promotes violence, hate, discrimination, or harassment

  • Distribute explicit sexual content, pornography, or adult material

  • Publish content that exploits, abuses, or endangers minors

  • Spread false, misleading, or fraudulent information with malicious intent

Rights violations:

  • Infringe intellectual property rights (copyright, trademarks, patents)

  • Publish content without proper license, permission, or attribution

  • Impersonate another person or entity

  • Use usernames, slugs, or brands confusingly similar to other entities

Malicious technical activities:

  • Attempt unauthorized access to accounts, systems, or data of other users

  • Distribute malware, viruses, malicious scripts, or harmful code

  • Perform denial of service attacks (DoS/DDoS)

  • Exploit security vulnerabilities without responsible disclosure

  • Automate actions through bots without express authorization (scraping, spam)

Spam and abuse:

  • Send unsolicited messages or excessive promotional content

  • Participate in pyramid schemes, scams, or fraud

  • Manipulate metrics, rankings, or statistics artificially

  • Create multiple accounts to evade restrictions or suspensions

Abusive use of resources:

  • Intentionally overload servers or infrastructure

  • Store or publish extremely large files without justification

  • Use Vlogerly as a generic file storage service

5.4. Content Moderation

Vlogerly reserves the right, but not the obligation, to:

  • Review, monitor, or moderate User Content

  • Remove or block content that violates these Terms

  • Suspend or terminate accounts of violating users

  • Cooperate with legal authorities in investigations

We are not responsible for content published by users. Content review is performed based on reports, automated systems, or random review, not exhaustively.


6. User Content and Intellectual Property

6.1. Content Ownership

You retain all ownership rights to the User Content you create, upload, or publish on Vlogerly. This includes:

  • Blog articles (text, formatting, structure)

  • Images, videos, and other multimedia files

  • Categories, tags, titles, and metadata

  • Project descriptions and biographies

Vlogerly does not claim ownership of your content. You are the copyright holder and may use, modify, distribute, or delete your content as you wish, subject to the license you grant us according to section 6.2.

6.2. License Granted to Vlogerly

By publishing User Content, you grant Vlogerly a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

  • Store, process, and display your content on the platform

  • Distribute published articles in the Blog Center

  • Generate thumbnails, Open Graph images, and previews

  • Make backup copies and security archives

  • Optimize images and files to improve performance

  • Display excerpts or previews in search engines and social networks

  • Allow Blog Center visitors to view your public content

License scope: This license is necessary to operate and provide the service. We do not use your content for our own commercial, advertising, or marketing purposes without your explicit consent.

Duration: The license remains in effect while your content is stored on Vlogerly. Upon deleting content, the license terminates, except for backup copies that will be deleted within a reasonable period (up to 90 days).

6.3. Public vs. Private Content

Published articles: Articles with "published" status are publicly accessible in the Blog Center. Anyone with the link can view, share, or index them in search engines.

Private articles/drafts: Articles with "draft", "private", "scheduled", or "archived" status are not publicly accessible and only you can view them from your administrative workspace.

Visibility control: You can change the publication status of your articles at any time from the administrative panel. An article's visibility changes immediately when its status is modified.

6.4. Content Responsibility

You are solely responsible for:

  • The legality, truthfulness, and accuracy of your User Content

  • Obtaining permissions, licenses, and necessary rights before publishing

  • Complying with intellectual property, privacy, and data protection laws

  • Legal consequences arising from your content

Vlogerly does not validate, endorse, or guarantee the accuracy of content published by users. We are not responsible for damages, losses, or claims arising from User Content.

6.5. Third-Party Rights

Do not publish content that:

  • Infringes copyright, trademarks, or patents of third parties

  • Contains confidential information or trade secrets without authorization

  • Violates privacy, publicity, or image rights of other persons

  • Uses names, logos, or trademarks of third parties without permission

If you receive a copyright infringement notice (DMCA or similar), you must:

  1. Remove the infringing content immediately

  2. Provide evidence that you have the right to publish the content

  3. Cooperate with our investigation

Repeated violations may result in permanent suspension of your account.

6.6. Content Deletion

You can delete your User Content at any time from the administrative workspace. Upon doing so:

  • Content is removed immediately from public view

  • Third-party cached copies (Google, social networks) may persist temporarily

  • Backup copies are deleted within up to 90 days

  • Associated metadata (views, statistics) are retained in aggregated and anonymous form

Important note: Content deletion is permanent and irreversible. Vlogerly cannot recover deleted content once the process is complete.


7. Privacy and Data Protection

7.1. Data Collection

Vlogerly collects, processes, and stores personal data as described in our Privacy Policy, including:

  • Account information (name, email, username, avatar)

  • Authentication data (encrypted password, session tokens)

  • User Content (articles, projects, metadata)

  • Usage data (pages visited, actions performed, timestamps)

  • Technical information (IP address, browser, device)

7.2. Data Use

We use your personal data to:

  • Provide, operate, and improve the Services

  • Authenticate your identity and maintain account security

  • Communicate with you about updates, changes, or support

  • Analyze platform usage and detect technical issues

  • Comply with legal obligations and resolve disputes

We do not sell or rent your personal data to third parties for commercial purposes.

7.3. Third-Party Services

Vlogerly integrates third-party services that process data according to their own privacy policies:

  • Firebase (Google): User authentication

  • Hotjar: Behavior analysis and UX

  • Sentry: Error monitoring

  • Cloudinary: Image storage

  • Resend: Transactional email sending

  • PostgreSQL/Neon: Database

By using Vlogerly, you agree that these services process your data according to their policies. See section 5 of our Cookie Policy for more details.

7.4. International Transfers

Some of our providers may store or process data outside the European Economic Area (EEA), including the United States. We ensure these transfers comply with:

  • Standard Contractual Clauses (SCC) approved by the European Commission

  • EU-U.S. Data Privacy Framework (when applicable)

  • Adequate security measures to protect your data

7.5. Your Privacy Rights

Under GDPR and other data protection laws, you have the right to:

  • Access your personal data

  • Rectify inaccurate information

  • Delete your data (right to be forgotten)

7.6. Data Retention

After deleting your account, we retain:

  • Aggregated and anonymized data indefinitely (statistics, metrics)

  • Backup copies for a maximum of 90 days

  • Audit and security logs as per legal requirements (up to 6 years in some jurisdictions)


8. Payment and Billing

8.1. Current Service Model

Vlogerly is currently free. We do not charge for:

  • Account creation

  • Project creation

  • Article publishing

  • Content storage (within reasonable limits)

  • Use of the administrative workspace or Blog Center

8.2. Future Payment Plans

Vlogerly reserves the right to introduce premium payment plans in the future that may include:

  • Advanced features (premium analytics, custom domains, exclusive themes)

  • Expanded limits (more projects, articles, storage)

  • Priority support

  • Removal of Vlogerly branding

Commitment: Current users with free accounts will retain access to current basic functionalities for free even after the introduction of payment plans. We will notify 60 days in advance before implementing changes affecting free users.

8.3. Payment Processing

When payment plans are implemented, payments will be processed through secure external providers (Stripe, PayPal, or others). Vlogerly does not store credit card information on its servers.

Accepted payment methods: (to be determined when payment plans are implemented)

Currency: Prices will be displayed in USD, EUR, or other currencies depending on availability.

8.4. Refunds

Refund policies will be defined when payment plans are implemented. In general:

  • Subscription payments are non-refundable except as required by law

  • You may cancel your subscription at any time; you will continue to have access until the end of the billing period

  • Discretionary refunds may be granted in exceptional cases (billing errors, service breach)


9. Account Suspension and Termination

9.1. Suspension for Terms Violation

Vlogerly may suspend your account immediately, without prior notice, if:

  • You violate any provision of these Terms

  • You publish prohibited content according to section 5.3

  • You receive multiple valid reports of rights infringement

  • You attempt unauthorized access to other systems or accounts

  • You participate in fraudulent or illegal activities

During suspension:

  • You will not be able to access the administrative workspace

  • Your published articles will be temporarily hidden from the Blog Center

  • You will not be able to create, edit, or delete content

  • You will receive a notification explaining the reason for the suspension

Appeal: You may appeal a suspension by contacting our support team with evidence supporting your case. We will review each appeal within 7 business days.

9.2. Permanent Termination

Vlogerly may permanently delete your account if:

  • You repeatedly violate these Terms after previous suspensions

  • You participate in serious illegal activities (child abuse content, terrorism, fraud)

  • You create multiple accounts to evade suspensions

  • You do not respond to warnings or contact attempts during a suspension

Consequences of termination:

  • Permanent loss of account access

  • Deletion of all your User Content (projects, articles, images)

  • Ban from creating new accounts

  • Possible reporting to legal authorities depending on severity

Backups: We recommend regularly exporting your content. Vlogerly does not guarantee data recovery after permanent termination.

9.3. Voluntary Cancellation

You can cancel your account at any time from your profile settings. Upon doing so:

  • Your account is deactivated immediately

  • You lose access to the administrative workspace

  • Your public articles are hidden from the Blog Center

  • Your content is marked for permanent deletion after 30 days (grace period)

Grace period: During the first 30 days after cancellation, you can contact us to reactivate your account and recover your content. After this period, deletion is permanent and irreversible.

9.4. Effects of Termination

After termination of your account (voluntary or forced), the following provisions remain in effect:

  • Sections 6 (Intellectual Property), 10 (Limitation of Liability), 11 (Indemnification), 13 (Applicable Law)

  • Pending payment obligations (if any)

  • Legal responsibilities arising from your use of Vlogerly


10. Limitation of Liability and Warranties

10.1. "As Is" Service

Vlogerly is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to:

  • Warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement of third-party rights

  • Uninterrupted or error-free availability

  • Accuracy, reliability, or completeness of results

We do not guarantee that:

  • The service will be available 24/7 without interruptions

  • Data will be completely protected against loss

  • Functionalities will meet all your specific requirements

  • Errors will be corrected within specific timeframes

10.2. Service Availability

Vlogerly strives to keep the service available and functional, but we do not guarantee a specific service level (SLA). The service may experience:

  • Scheduled maintenance (with prior notice when possible)

  • Unplanned interruptions due to technical failures

  • Performance degradation during high load periods

  • Changes to functionalities without prior notice

Recommendation: Keep backup copies of your important content. Vlogerly performs automatic backups, but we do not guarantee their availability or recovery in all scenarios.

10.3. Disclaimer of Liability

To the maximum extent permitted by applicable law, Vlogerly will not be liable for:

Direct damages:

  • Loss of data, content, or information

  • Loss of revenue, profits, or business opportunities

  • Costs of acquiring substitute services

  • Business or professional activity interruption

Indirect, incidental, special, consequential, or punitive damages:

  • Reputation damage

  • Loss of opportunities

  • Emotional damages or distress

  • Any other intangible damages

Maximum limitation: If a jurisdiction does not allow total exclusion of liability, our total liability to you for any claim related to Vlogerly will be limited to the amount you have paid for the service in the previous 12 months (currently $0 on the free plan).

10.4. Third Parties

Vlogerly is not responsible for:

  • Actions, omissions, or policies of integrated third-party services (Firebase, Hotjar, Cloudinary, etc.)

  • Content published by other users

  • Links to external websites from user articles

  • Incompatibilities with browsers, devices, or third-party software

Recommendation: Review the privacy policies and terms of service of integrated third parties.

10.5. Force Majeure

Vlogerly will not be liable for breaches caused by force majeure events beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, fires)

  • Wars, terrorism, or civil unrest

  • Internet infrastructure or external provider failures

  • Cyberattacks or malicious actions by third parties

  • Changes in laws or regulations affecting the service

  • Pandemics or health emergencies


11. Indemnification

You agree to indemnify, defend, and hold harmless Vlogerly, its affiliates, directors, employees, agents, and providers from any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising from or related to:

  • Your use or misuse of Vlogerly

  • Your User Content

  • Your violation of these Terms

  • Your violation of laws, regulations, or third-party rights

  • Any dispute between you and other users

  • Unauthorized access to your account due to negligence in security

Cooperation: In case of claims, you will fully cooperate with Vlogerly in defending them and follow our reasonable instructions.

Defense control: Vlogerly reserves the right to assume exclusive defense and control of any matter subject to indemnification, without relieving you of your indemnification obligations.


12. Vlogerly's Intellectual Property

12.1. Vlogerly's Rights

All rights, titles, and interests in and to Vlogerly (excluding your User Content) are and will remain the exclusive property of Vlogerly and its licensors, including:

  • Source code, design, architecture, and platform structure

  • "Vlogerly" trademark, logos, icons, and visual elements

  • Documentation, tutorials, and support materials

  • Proprietary technologies, algorithms, and processes

  • Databases, compilations, and data aggregations

12.2. Limited License

Vlogerly grants you a limited license to use our trademarks and logos only for the purpose of:

  • Identifying that you use Vlogerly as a blogging platform (e.g., "Powered by Vlogerly" in the Blog Center footer)

  • Sharing screenshots for educational or review purposes

You may not:

  • Modify, alter, or create derivative works of our trademarks

  • Use our trademarks in a way that implies sponsorship, affiliation, or endorsement without authorization

  • Register trademarks, domains, or trade names confusingly similar

  • Use our trademarks in a derogatory, defamatory, or reputation-damaging manner

12.3. Feedback

If you provide suggestions, ideas, comments, or feedback about Vlogerly ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, implement, and commercialize such Feedback without compensation or attribution.

We are not obligated to:

  • Keep Feedback confidential

  • Implement provided suggestions

  • Compensate you for implemented ideas


13. Applicable Law and Dispute Resolution

13.1. Applicable Law

Your use of Vlogerly may also be subject to other applicable local, state, national, or international laws in your jurisdiction.

13.3. Jurisdiction

14. General Provisions

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Vlogerly regarding use of the service, and supersede all prior agreements, communications, or understandings, whether oral or written.

14.2. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by a competent court, such provision will be modified and interpreted to achieve the objectives of the original provision to the maximum extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14.3. Waiver

Vlogerly's failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver of any provision must be in writing and signed by an authorized representative of Vlogerly.

14.4. Assignment

You may not assign, transfer, or sublicense these Terms or any rights granted hereunder without Vlogerly's prior written consent. Vlogerly may assign these Terms freely without your consent, including to any affiliate or in connection with a merger, acquisition, reorganization, or sale of assets.

14.5. Relationship of Parties

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Vlogerly. You have no authority to bind Vlogerly to any commitment or contract.

14.6. Survival

Provisions that by their nature should survive termination of these Terms (including but not limited to sections on Intellectual Property, Limitation of Liability, Indemnification, Applicable Law) will continue in effect after termination.

14.7. Notices

All notices, notifications, and communications required or permitted under these Terms will be made:

To you: Via email to the address associated with your account or via prominent notice on the platform.

To Vlogerly: Via email to the contact address available in our Privacy Policy.

Notices are deemed received:

  • Immediately if sent by email

  • 24 hours after posting on the platform

14.8. Language

These Terms are written in English. Any translation to other languages is provided for convenience only. In case of conflict between versions, the English version will prevail.

Section headings in these Terms are included for convenience only and do not affect the interpretation of provisions.

Yes, you can use Vlogerly for personal and commercial blogs as long as the content complies with these Terms and does not violate third-party rights.

Is Vlogerly really free?

Yes, Vlogerly is currently completely free. We do not charge for creating accounts, projects, or publishing articles. In the future, we may introduce optional premium plans, but basic functionalities will remain free for current users.

Can I export my content?

Yes, we recommend regularly exporting your articles. You can currently copy content manually from the editor. We are working on a bulk export feature in standard formats (Markdown, JSON).

What happens if I delete my account by mistake?

You have a 30-day grace period after canceling your account to contact us and request reactivation. After this period, deletion is permanent and irreversible.

Can I change my username?

Yes, you can change your username from your profile settings, provided the new name is available and complies with our rules (3-20 characters, only letters, numbers, underscores, and dots).

Does Vlogerly have storage limits?

Can I use my own custom domain?

Currently, articles are published on Vlogerly's domain (Blog Center). Custom domain functionality is on our roadmap and may be introduced in future premium plans.

What happens to my content if Vlogerly shuts down?

In the unlikely event that Vlogerly ceases operations, we will notify users 90 days in advance and provide export tools so you can recover all your content before closure.

Can I collaborate with other users on a project?

Currently, each project belongs to a single user. Multi-user collaboration functionality is in development and will be implemented in future updates.

How do I report inappropriate content?

If you find content that violates these Terms, contact our moderation team via the support email. We will investigate and take appropriate action within 7 business days.

Does Vlogerly use my content to train AI?

No. Vlogerly does not use your User Content to train artificial intelligence models or share it with third parties for that purpose without your explicit consent.

Can I monetize my blog on Vlogerly?

Yes, you can monetize your content through affiliate links, sponsorships, or external advertising as long as you comply with applicable laws and properly disclose commercial relationships in your articles. Vlogerly does not share revenue from external monetization.
